Associations can affect your sale

Illinois condo sellers must provide disclosure documents under Section 22.1 of the Condominium Property Act, usually obtained from the association or management company for a fee. Ordering them early prevents closing delays.

Your building's finances matter to buyers and lenders. Strong reserves help, while pending special assessments, litigation, or a lack of FHA approval can narrow the pool of buyers.

Common questions

What documents do I need to sell my condo?

The 22.1 disclosure package from your association, including the declaration, rules, budget, reserves, and information about special assessments and litigation, plus a paid assessment letter for closing.

Who pays for the 22.1 documents?

Typically the seller, and management companies usually charge a fee. Order them as soon as you're under contract, or before.

Does FHA approval matter when selling?

It can. FHA-approved buildings are open to more buyers, including first-time buyers with smaller down payments.

What if there's a special assessment coming?

It must be disclosed, and who pays is often negotiated. Being upfront avoids problems during attorney review.

Can I sell my condo with a tenant in it?

Yes. The lease transfers to the buyer, which can appeal to investors if the building allows rentals.
