Illinois wholesaling rules
Illinois treats wholesaling as licensed activity once it becomes a pattern of business. Under the Illinois Real Estate License Act, marketing or assigning purchase contracts in more than one transaction within 12 months generally requires a real estate license.

Is wholesaling legal in Illinois?
Yes, but Illinois regulates it. Under the Illinois Real Estate License Act, a person who markets, assigns, or deals in real estate purchase contracts as a pattern of business, generally more than one transaction in a 12-month period, needs a real estate license. Wholesalers should have a real estate attorney review their contracts and marketing.
What is an assignment of contract?
The wholesaler signs a contract to buy a property, then assigns that contract to an end buyer for a fee. The end buyer closes with the seller. Some sellers' contracts or lenders restrict assignments, so check the contract terms first.
What is a double close?
In a double close, the wholesaler buys the property and resells it to the end buyer, often on the same day. It keeps the assignment fee private but adds closing costs and usually requires transactional funding.
How do I get on your cash buyer list?

Should I accept a wholesaler's offer for my house?
Maybe, if speed and certainty matter most. But a wholesaler's offer is usually below what an investor would pay directly. Before you sign, ask a licensed agent what your home would sell for as-is, so you know what you're giving up.
